Synopsis-
Eric Smith, a thirteen-year-old boy brutally murdered an innocent five-year-old boy named Derrick Robie. Derrick was heading to the park one day and Eric told the young boy he knew a short cut. Eric guided Derrick into the woods; their Eric choked and beat Derrick to death with a large rock, he then proceeded to sexually abuse Derrick's lifeless body! Eric Smith eventually confessed to the murder, was tried as an adult, and sentenced to nine years in prison.
Why did Eric kill?
That is a question we will probably never know the answer to. Actually, the only person who might know would be Eric himself, however, I'm not sure if even he really knows. I'm not sure why Eric thought killing another person was the answer to his problems, but I think I know why he chose Derrick Roby. Eric was an odd looking boy, who struggled in school, mentally and socially. Eric was also raised in a questionable environment, with claims by Eric's stepsister of mental and sexual abuse by the hands of their stepfather. While on the other hand, Derrick was an attractive, smart, athletic boy, who was loved by everyone. I believe the prosecutor for the Robie family said it best, "Eric killed the symbol of all the things he was not."

Was it Premeditated?
This question is also very difficult to answer. I guess it depends on your definition of premeditated. Webster's Dictionary defines premeditated as, characterized by fully conscious willful intent and a measure of forethought and planning. Did Eric plan to murder Derrick days in advance; did he plan every aspect of how he would commit the crime? No, I don' think so! But personally, I believe a person can premeditate any act with little time. I believe Eric was fully conscious with willful intent, and with in minutes he decided to kill Derrick Robie.
At age 1, should he have been tried as an adult? Why or why not?
Yes, it was the right decision for Eric to be tried as an adult. Unless, a person suffers from some type of serious learning disability, by age 1 a person should have a good enough understanding of right and wrong, to know that taking another persons life is wrong. The only other reason why a person might not know that killing is wrong is because they were never taught; therefore, the parents would be at fault. I don't think that is the case in this story; however, I do believe parents should be held accountable for, their child's actions if those actions are a result of poor parenting.
What do you think about how the prosecution and defense handled the case?
There seemed to be some controversy over how Eric's confession was obtained by the police. However, the prosecution was able to convince the judge to allow it. I think that was a crucial piece of evidence, because it revealed Eric's mind set the day he murdered Derrick. I don't think the defense had much to work with, so they did the best they could with what they had.
What do you think Eric's emotional and mental state was?
I think Eric was emotionally exhausted, confused, frustrated, angry, depressed, and desperate for a cure for his pain. However, these are all emotions experienced by millions of people on a daily basis, and none are an acceptable excuse for murder.
When you heard about the rage disorder, did it impact your thoughts in any way? How?
Yes, it did impact my thoughts. It made me feel that more confident that I was right to think Eric should be tried as an adult and sentenced to years in prison. I imagine there are millions of people who suffer from rage disorder. Just because you have a hard time controlling your rage, doesn't mean you should get a free pass to murder.
What did you think about the biological theory as it pertained to his low set ears/hair?
To be brutally honest, I thought it was a pile of #@$!
Applying the Classical theory, do you think Eric chose to kill?
With out a doubt! The core thought of the Classical Theory is that "people exist in a world with free will and make their own rational choices, although they have a natural tendency toward self-interest and pleasure."(Criminological Theory pg.) The Positive theory would have you believe Eric was born a potential murderer, which might be true, and society reinforced his biology and intensified his desire to kill, which is also possible, however, to believe that Eric has no moral responsibility, as claimed by the Positive theory, is absurd! Those followers of the positive theory believe the answer to crime is science and rehabilitation. Does Eric need and deserve psychiatric treatment? Sure! And he'll have plenty of time for that during and after his sentence is complete!
Do you agree with the Verdict?
I would like to have seen a longer sentence with a combination of psychiatric treatment
Put yourself in the role of the defense and prosecution, what would you have done differently?
Prosecution- I wouldn't change a thing
Defense-I would of thought twice about taking the case!
